Regulations for the Designation of Physicians to Perform Induced Abortion or Sterilization Procedures

Article 1
These Regulations are enacted in accordance with Paragraph 2 of Article 5 of the Reproductive Health Act.
Article 2
Physicians who meet the qualifications stipulated in Article 3 or 4 of these Regulations shall be qualified to perform induced abortion or sterilization procedures.
Article 3
Physicians who perform surgery of induced abortion shall meet one of following qualifications:
1. Possessing obstetrics and gynecology specialist certificate.
2. Legally registered practice of obstetrics and gynecology.
Article 4
Physicians who perform sterilization procedures shall meet one of following qualifications:
1. Possessing a specialist certificate in obstetrics and gynecology, surgery, or urology.
2. Legally registered practice of obstetrics and gynecology, surgery, or urology.
Article 5
Physicians who meet the qualifications stipulated in these Regulations to perform induced abortion or sterilization procedures shall provide appropriate consulting services to the individual who undergoes such operations before and after the surgery.
Article 6
Any matters which are not provided for in these Regulations shall be governed by the relevant provisions of the Physicians Act or the Medical Care Act.
Article 7
For physicians who were issued a Reproductive Health Physician Certificate prior to the implementation of these amended Regulations, the certificate shall no longer be reissued or replaced if it is lost or damaged after the amendments take effect.
The Reproductive Health Physician Certificate shall be revoked if the physician holding the certificate meets any one of the following conditions:
1. The physician has suspended or terminated medical practice.
2. The physician has been suspended from practice or had their license revoked due to disciplinary actions.
3. The physician holds a Reproductive Health Physician Certificate for performing induced abortion, but their registered specialty has been changed to one other than obstetrics and gynecology.
4. The physician holds a Reproductive Health Physician Certificate for performing vasectomy or tubal ligation, but their registered specialty has been changed to one other than obstetrics and gynecology, surgery, or urology.
A physician whose Reproductive Health Physician Certificate was revoked pursuant to Subparagraph 3 or 4 of the preceding paragraph may still perform induced abortion or sterilization procedures if they meet the qualifications set forth in Subparagraph 1 of Article 3 or Subparagraph 1 of Article 4, or if the reason for revocation under the preceding paragraph has been eliminated and the physician meets the qualifications prescribed in Article 3 or 4.
Article 8
These Regulations shall come into force as of the day of promulgation.
