Article 1
These Regulations are enacted in accordance with Paragraph 4, Article 36 of the Act for the Establishment and Management of Free Trade Zones (hereinafter referred to as the “Act”).
Article 2
For the following persons required to stay in a Free Trade Zone (hereinafter referred to as “FTZ”) for over 24 hours, the applicants referred to in the following subparagraphs shall submit the application in advance together with identification documents with an explanation of residence purpose and related information to the responsible FTZ management authority (hereinafter referred to as “Management Authority”) for approval and consent to reside in the FTZ:
1. For the government employees: the application shall be submitted by the relevant authority in charge.
2. For duty officers or security personnel of operational offices in a FTZ (hereinafter referred to as "Operational Office"): the application shall be submitted by the Operational Office.
3. For employees of enterprises in a FTZ (hereinafter referred to as "FTZ enterprise "): the application shall be submitted by their employers.
4. For individuals visiting a FTZ for commercial purposes: the application shall be submitted by the relevant enterprise.
5. For persons required to reside in a FTZ for justified reasons such as other business or security maintenance: the application shall be submitted by their employers or themselves.
For individuals from Mainland China, Hong Kong and Macao or foreign nationals, the following documents shall be additionally attached with the application aforementioned in Paragraph 1:
1. Passports or entry-exit permits issued by the National Immigration Agency.
2. Alien Residence Certificates.
Article 3
Individuals and vehicles shall be permitted to enter or exit the FTZ upon presentation of an access permit or pass granted by the Management Authority, followed by successful completion of inspection by police or security guards of the Operational Office at the FTZ entrance.
Technological facilities, plus related management measures, may be applied to complete the inspection referred to in the preceding paragraph.
Article 4
Access permits or passes for individuals and vehicles are classified as follows:
1. Long-term access permits or passes: valid for more than 24 hours but less than 3 years.
2. Temporary access permits or passes: valid for no more than 24 hours.
In order to apply for long-term access permits or passes of the employees of FTZ enterprises mentioned in the preceding paragraph, the applicant shall submit identification documents together with an explanation of the entry and exit purpose as well as the duration of stay, and their employers shall compile the same documents in advance and submit an application with the Management Authority for approval. The same procedure shall apply where the long-term access permits or passes shall be renewed upon expiration.
The Management Authority, when issuing the long-term or temporary permits or passes referred to in Paragraph 1, shall indicate in the permits or passes a validity period and permitted access areas in the FTZ.
Article 5
Those who occasionally enter and exit FTZs for non-regular business events, visits or other particular purposes, shall submit to the Management Authority the following documents in order to apply for a temporary access permit or pass as aforementioned in the Subparagraph 2, Paragraph 1 of the preceding Article:
1. An individual applying for a temporary access permit or pass shall submit identification documents together with an explanation of the entry and exit purpose.
2. To apply for temporary access permits or passes for vehicles, the relevant public service offices, the Operational Offices, business enterprises or drivers shall submit the original vehicle licenses.
Article 6
To apply for long-term access permits or passes for vehicles, the public service offices, the Operational Offices, or business enterprises shall submit to the Management Authority the required application forms, a copy of vehicle registration and any other relevant information for approval.
Article 7
The Management Authority will deny long-term access permits or passes to applicants, revoke or annul the approval, if any, and cancel the access permits or passes, for any of the following circumstances: 1. The holder of an access permit or pass has been wanted or sentenced to imprisonment, regardless of whether the execution of the sentence has begun or is ongoing. 2. The holder of an access permit or pass has been restricted or prohibited from entering/exiting the borders.
Article 8
Where any person holding the long-term access permit or pass is found misusing, forging or fabricating another person’s long-term access permit or pass, or engaging in smuggling activities notified by the relevant authority, the Management Authority shall annul the approval and cancel the permit or pass and deny any further application for long-term and temporary access permit or pass from the applicant within three months as of the date of cancelation.
Article 9
Those who lose long-term access permits or passes shall report to the Management Authority and the Operational Office, and present the relevant documentation to apply for re-issue of the permits or passes with the Management Authority.
Where the long-term access permits or passes have been lost for three times cumulatively within the valid terms, the Management Authority shall deny the applications for re-issue of the same within one month as of the date when the applicants report the loss.
Article 10
Long-term access permits or passes shall be returned to the Management Authority by the FTZ enterprises when they are closed, or their operations are revoked or annulled upon approval by the Management Authority or due to the death or resignation of their employees who hold the long-term access permits or passes, or when such employees are no longer required to enter/exit the FTZs. The Management Authority can annul the approval and cancel the access permits or passes that should have been returned but have not been. The same applies to the long-term access permits or passes for vehicles.
Article 11
If a long-term access permit or pass is unrecognizable, the applicant shall apply for a replacement and return the old permit or pass at the same time.
Article 12
Holders with the following approved documentation can access designated locations as follows:
1. Airport access permits holders providing ground handling services engaging in hauling pallets and containers shall be admitted to enter and exit the operational zone of the airport FTZ with connections to the exclusive passage to airport aprons.
2. Customs brokers holding approved documentation issued by the Operational Office shall be admitted to enter and exit inspection zones of cargo terminals in the FTZs.
Article 13
The Management Authority may commission police departments or the Operational Offices in FTZs to undertake the following tasks:
1. Accepting, reviewing, issuing, handling the loss of, producing, canceling, and collecting long-term access permits or passes for the personnel or vehicles referred to in Articles 4 and 6 to 9, and charging the government fees referred to in Article 45 of the Act.
2. Accepting, reviewing and issuing of temporary access permits or passes, as referred to in Article 5.
The Management Authority may commission the activities of accepting and reviewing the application for residence in the FTZs, as referred to in Article 2, to the Operational Office.
In the case of the circumstances referred to in the preceding two paragraphs, the Management Authority shall announce the matter commissioned and the legal basis thereof, and publish the same information in the Government Gazette.
Article 14
These Regulations shall become effective on the date of promulgation.
