Regulations Governing the Establishment of, Alterations to, and Cessation of Operations of Junior College Continuing Education Divisions

Article 1
These Regulations have been formulated in accordance with the provisions of Paragraph 1, Article 11 of the Junior College Act (hereunder referred to as “the Act”).
Article 2
The establishment of, alterations to, and cessation of operations of a junior college continuing education division shall be undertaken in accordance with the provisions of these Regulations.
The transformation of affiliated supplementary advanced education schools and evening divisions of junior colleges, technical colleges, or universities of science and technology into continuing education divisions, in accordance with the provisions of Paragraph 2, Article 11 of the Act, shall be undertaken in accordance with the provisions of these Regulations.
Article 3
Details of the establishment of a division of continuing education at a junior college shall, in accordance with the provisions of Paragraph 1, Article 18 of the Act, be incorporated into its charter and by-laws. The proposed revision of the junior college’s charter and by-laws shall be deliberated on by its governing board, and if the governing board passes a resolution approving the revision, in accordance with the provisions of Article 45 of the Act, the junior college shall submit the proposed new charter and by-laws to the Ministry of Education (hereunder abbreviated to “the Ministry”) for ratification before implementing them.
Article 4
A junior college continuing education division shall have a director who is responsible for overall management of the division’s affairs. The president of the junior college shall appoint a full-time teacher at the rank of at least assistant professor to fill this post in a concurrent capacity.
Article 5
Each department of a junior college continuing education division shall have a head of department who is responsible for overall management of the department’s affairs. This post shall be filled in a concurrent capacity by a person who is currently the head of a daytime division department. However, if there is no related daytime division department, a full-time teacher in that continuing education division shall fill the post in a concurrent capacity.
Article 6
A junior college continuing education division may be merged with another administrative unit at the same junior college. If such a merger involves a change to the organization or name of the division the junior college shall amend its charter and by-laws. The proposed amendments of the charter and by-laws shall be deliberated on by the governing board of the educational institution, and if the governing board passes a resolution approving the amendments, in accordance with the provisions of Article 45 of the Act, the proposed new charter and by-laws shall be submitted to the Ministry for ratification before the merger is implemented.
Article 7
The cessation of admission of students into the departments of a junior college continuing education division shall be handled in accordance with the provisions of the Standards Governing the Overall Scale of Development and Resources of Junior Colleges and Institutions of Higher Education and be reported to the Ministry for ratification.
After the current students in each department have graduated or been suitably placed to continue their education elsewhere, the junior college shall amend its charter and by-laws. The proposed amendments of the charter and by-laws shall be deliberated on by its governing board, and if the governing board passes a resolution approving the amendments, in accordance with the provisions of Article 45 of the Act, the proposed new charter and by-laws shall be submitted to the Ministry for ratification before its continuing education division ceases operations.
Article 8
A junior college, technical college or university of science and technology shall amend its charter and by-laws within a year from November 8, 2019, the date that the amendments to these Regulations came into effect. The proposed amendments of the charter and by-laws shall be deliberated on by the governing board of the educational institution, and if the governing board passes a resolution approving the amendments, in accordance with the provisions of Article 45 of the Act, the proposed new charter and by-laws shall be submitted to the Ministry for approval of the transformation of its affiliated supplementary advanced education school and/or evening division into a continuing education division.
When handling a transformation in accordance with the provisions of the previous paragraph, the educational institution shall undertake detailed planning to ensure that student learning, the teaching of courses, and the rights and interests of teachers, all other staff members, and students are not compromised, and regarding other associated matters.
Article 9
These Regulations shall come into effect on the day of promulgation.
