Article 1
This Act is enacted to underscore the cultural and historical significance of Memorial Days and Festivals, to designate national holidays, and to prescribe the organization of commemorative and celebratory activities. It seeks to honor the nation's historical development, safeguard the traditional folk customs of various ethnic groups, and foster multicultural advancement.
The implementation of Memorial Days and Festivals shall be governed in accordance with the provisions of this Act.

Article 2
The competent authority for this Act is the Ministry of the Interior.
Article 3
The Memorial Days and their dates are as follows:
1. Founding Day of the Republic of China: January 1.
2. Peace Memorial Day: February 28.
3. Memorial Day of Dr. Sun Yat-sen’s Death: March 12.
4. Anti-Aggression Day: March 14.
5. Ethnic Equality Memorial Day: March 21.
6. Revolutionary Martyrs Memorial Day: March 29.
7. Freedom of Speech Day: April 7.
8. Indigenous Peoples Resistance Day: June 26.
9. Commemoration Day of the Lifting of Martial Law: July 15.
10. Indigenous Peoples Day: August 1.
11. End of War Memorial Day: August 15.
12. 823 Artillery Bombardment Memorial Day: August 23.
13. National Disaster Preparedness Day: September 21.
14. Confucius’ Birthday: September 28.
15. National Day: October 10.
16. Taiwan United Nations Day: October 24.
17. Taiwan Retrocession Day and Memorial Day of Great Victory at Kuningtou Kinmen: October 25.
18. Dr. Sun Yat-sen’s Birthday: November 12.
19. Constitution Day: December 25.
20. National Hakka Day: December 28.

Article 4
Each of the following Memorial Days shall be observed as a one-day holiday; no holiday shall be granted for any others:
1. Founding Day of the Republic of China.
2. Peace Memorial Day.
3. Confucius’ Birthday.
4. National Day.
5. Taiwan Retrocession Day and Memorial Day of Great Victory at Kuningtou Kinmen.
6. Constitution Day.

Article 5
The Festivals and their dates are as follows:
1. Customary holidays and festivals:
(1) Lunar New Year: the 1st day of the 1st lunar month.
(2) Lantern Festival: the 15th day of the 1st lunar month.
(3) Qingming Festival: on Qingming Day (Clear and Bright Day), the 5th of the twenty-four solar terms.
(4) Dragon Boat Festival: the 5th day of the 5th lunar month.
(5) Zhongyuan Festival: the 15th day of the 7th lunar month.
(6) Mid-Autumn Festival: the 15th day of the 8th lunar month.
(7) Double Ninth Festival: the 9th day of the 9th lunar month.
(8) Lunar New Year’s Eve: the last day of the 12th lunar month.
(9) Indigenous rituals and ceremonies: The dates of holidays for indigenous rituals and ceremonies shall be announced by the Council of Indigenous Peoples, after taking into account the customs of each indigenous people and consulting with the respective indigenous communities. The announcement shall be published in the Government Gazette.

4. Farmers’ Day: on Lichun Day (the Beginning of Spring), the 1st of the twenty-four solar terms.
5. Women’s Day: March 8.

9. Children’s Day: April 4.
10. Buddha’s Birthday: the 8th day of the 4th lunar month.
11. Labor Day: May 1.
12. International Nurses’ Day: May 12.
13. Mother’s Day: Second Sunday in May.
14. Environment Day: June 5.
15. National Ocean Day: June 8.
16. Police Day: 15 June.
17. Fishermen’s Day: 1 July.
18. Father’s Day: August 8.
19. Grandparents’ Day: Fourth Sunday in August.
20. Armed Forces Day: September 3.
21. National Sports Day: September 9.
22. Teachers’ Day: September 28.
23. Coast Guard Day: November 8.
24. Chinese Cultural Renaissance Day: November 12.

Article 6
The holidays for the memorial days and festivals specified in the preceding article shall be administered as follows:
1. Lunar New Year:
A five-day holiday shall be observed, beginning the day before Lunar New Year’s Eve and continuing through the third day of the first lunar month of the following year.
2. Single-Day Holidays:
A one-day holiday shall be granted for each of the following: Children’s Day, Qingming Festival, Labor Day, Dragon Boat Festival, Teachers’ Day, and Mid-Autumn Festival.
3. Indigenous Rituals and Ceremonies:
A three-day holiday shall be granted in accordance with the traditional ceremonial calendar of each respective indigenous ethnic group or tribe.
4. Firefighters’ Day and Police Day:
A holiday to be granted in accordance with the rules of respective competent authorities.
5. Armed Forces Day:
A holiday to be granted in accordance with the rules of the Ministry of National Defense.
6. Coast Guard Day:
A holiday to be granted in accordance with the rules of the Ocean Affairs Council.
If Children's Day and the Qingming Festival fall on the same date, an additional one-day holiday shall be granted on the day before. If that day falls on a Thursday, the additional holiday shall instead be granted on the following day, which is Friday.
No holidays are granted for festivals other than those specified in Paragraph 1.

A one-day holiday shall be granted for each of the following: Children’s Day, Qingming Festival, Labor Day, Dragon Boat Festival, Teachers’ Day, and Mid-Autumn Festival.
3. Indigenous Rituals and Ceremonies:
A three-day holiday shall be granted in accordance with the traditional ceremonial calendar of each respective indigenous ethnic group or tribe.
4. Firefighters’ Day and Police Day:
A holiday to be granted in accordance with the rules of respective competent authorities.
5. Armed Forces Day:
A holiday to be granted in accordance with the rules of the Ministry of National Defense.
6. Coast Guard Day:
A holiday to be granted in accordance with the rules of the Ocean Affairs Council.
If Children's Day and the Qingming Festival fall on the same date, an additional one-day holiday shall be granted on the day before. If that day falls on a Thursday, the additional holiday shall instead be granted on the following day, which is Friday.
No holidays are granted for festivals other than those specified in Paragraph 1.
Article 7
On designated Memorial Days, all government agencies shall fly the national flag. Relevant agencies, organizations, and schools shall observe the following protocols:
1. On the Founding Day of the Republic of China, Confucius’ Birthday, and National Day, commemorative activities shall be held.
2. On the Revolutionary Martyrs Memorial Day, spring rite ceremonies shall be conducted in honor of the fallen.
3. On the Peace Memorial Day, the national flag shall be flown at half-mast across the country for one day, accompanied by commemorative activities.
4. Other Memorial Days may be observed with appropriate activities in accordance with their respective significance.
On Festival days, government agencies, organizations, and schools may hold commemorative, celebratory, or traditional folk activities in accordance with the nature of the occasion.
1. On the Founding Day of the Republic of China, Confucius’ Birthday, and National Day, commemorative activities shall be held.
2. On the Revolutionary Martyrs Memorial Day, spring rite ceremonies shall be conducted in honor of the fallen.
3. On the Peace Memorial Day, the national flag shall be flown at half-mast across the country for one day, accompanied by commemorative activities.
4. Other Memorial Days may be observed with appropriate activities in accordance with their respective significance.
On Festival days, government agencies, organizations, and schools may hold commemorative, celebratory, or traditional folk activities in accordance with the nature of the occasion.
Article 8
If a memorial or festival holiday coincides with a regular day off, a substitute holiday shall be granted. Except where otherwise stipulated by applicable law, any adjustments to scheduled time off or corresponding make-up workdays shall be determined and officially announced by the competent authorities responsible for the respective sectors.
Article 9
Where special circumstances warrant, the substitute days off designated in Articles 4, 6, and the preceding article may be adjusted in accordance with the following provisions:
1. Government agencies and institutions that operate year-round under shift or rotation schedules—such as those in transportation, law enforcement, fire services, coast guard, medical services, customs, and correctional services—shall have their designated days off adjusted by the competent authorities responsible for the respective sectors.
2. Government agencies, institutions, and schools that provide public services other than those specified in the preceding paragraph may modify scheduled days off as required by operational demands, subject to approval by the competent authorities responsible for the respective sectors and provided that such adjustments do not compromise the continuity or quality of public service.
3. Military agencies may have their scheduled days off adjusted as necessary to ensure national defense, security, and operational readiness. Such adjustments shall be made by the competent authorities responsible for the respective sectors based on actual strategic and operational needs.

Article 10
This Act shall enter into force on the date of promulgation.
