Chapter I: General Provisions
Article 1
These standards are formulated in accordance with Article 67 of the Act for the Development of Tourism (hereinafter referred to as this Act).
Article 2
Violations of this Act or of orders issued in accordance with this Act shall be punished in accordance with the provisions of these Standards.
Article 3
The actions described in the preceding article shall be determined based on the results of the investigation of facts and evidence.
Article 4
Multiple violations of this Act or of orders issued in accordance with this Act shall be punished separately in accordance with the provisions of these Standards.
Chapter II: Sub-Provisions
Article 5
Tourist hotels and their employees in violation of the Act and the Regulations for Administration of Tourist Hotel Enterprises shall be fined as follows. General tourist hotel enterprises located in Municipal governments on the level of self-government of municipalities under the direct jurisdiction of the Executive Yuan shall be fined by the Government of Municipal governments on the level of self-government of municipalities under the direct jurisdiction of the Executive Yuan in accordance with the provisions of Schedule 1. The rest of the international tourist hotel enterprise and the general tourist hotel enterprise shall be fined by the Tourism Administration appointed by the Ministry of Transportation and Communications in accordance with the provisions of Schedule 1.

Article 6
Hotels and Their Employees in Violation of the Act and the Regulations for the Administration of Hotel Enterprises, self-government of municipalities under the direct jurisdiction of the Executive Yuan, or County or Township governments shall impose a penalty in accordance with the provisions of Schedule 2.

Article 7
For violations of this Act and the Regulations Governing Travel Agencies Committed by Travel Agencies and the Managers and Employees of Travel Agencies, the Ministry of Transportation and Communications shall appoint the Tourism Administration of travel agencies to impose penalties in accordance with the provisions of Schedule 3.

Article 8
Violations by Tourist Amusement Enterprises and Their Employees of this Act and the Regulations Governing Tourist Amusement Enterprises shall be fined by the Tourism Administration of Ministry of Transportation and Communications, self-government of municipalities under the direct jurisdiction of the Executive Yuan or county (city) government in accordance with the provisions of Schedule 4.

Article 9
Home Stay Facilities in Violation of the Act and Regulations for the Management of Home Stay Facilities shall be fined by the self-government of municipalities under the direct jurisdiction of the Executive Yuan or county (city) government in accordance with the provisions of Schedule 5.

Article 10
Violations by Tour Guides of this Act and the Regulations Governing Tour Guides shall be fined by the Tourism Administration of Ministry of Transportation and Communications in accordance with the provisions of Schedule 6.

Article 11
Violations by Tour Managers of this Act and the Regulations Governing Tour Managers shall be fined by the Tourism Administration of Ministry of Transportation and Communications in accordance with the provisions of Schedule 7.

Article 12
Water Recreation Activities in Violation of this Act and the Regulations Governing Water Recreation Activities shall be fined by the management authorities of water recreation activities in accordance with the provisions of Schedule 8.

Article 13
violations of this Act and management rules for Designated Scenic Spot regarding regulations governing designated scenic spots and tourist locations shall be fined by the Tourism Administration of Ministry of Transportation Communications, self-government of municipalities under the direct jurisdiction of the Executive Yuan, or County (City) Government in accordance with the provisions of Schedule 9.
Any person who violates the provisions of Articles 62 to 64 of this Act relating to the management of tourist areas shall be fined by the competent authorities for the related matters in accordance with the provisions of Schedule 9.

Article 14
Tourists entering national ecological and cultural reserve areas who have not applied for professional guides to accompany them shall be fined by the competent authorities for the related matters in accordance with the provisions of Schedule 10.

Chapter III Supplementary Provisions
Article 15
Article 5, Article 7, Article 8 Paragraphs 1 and 5, Article 10, Article 11, and appointments and the basis of the appointment in Article 13 Paragraph 1 shall be published in the government gazette or newspapers.
Article 16
A written disposition shall be prepared when imposing a penalty in accordance with the provisions of these standards. The format and matters to be included shall be determined by the Tourism Administration of the Ministry of Transportation and Communication. However, when penalties are imposed by competent authorities for the related matters in accordance with the provisions of Articles 62 to 64 of this Act, the format of and the matters to be included in the disposition letter shall be determined by the competent authorities for the related matters.
Article 17
The delivery of documents relevant to the penalties and investigations into facts and evidence shall be handled in accordance with the provisions of the Administrative Procedure Act.
Article 18
These standards shall take effect on the date of promulgation.
