Article 1
These Regulations are formulated in accordance with Paragraph 3, Article 3 of the Military Installation Safety Protection Act (hereinafter referred to as "the Act").
Article 2
The term "related authorities" as referred to in Subparagraph 1, Paragraph 1, Article 3 of the Act includes government agencies (or bodies), public legal persons, and corporations (hereinafter collectively referred to as "notified authorities").
If the military exercise or military training (hereinafter collectively referred to as "military exercises") takes place in privately owned fields, the military authority shall obtain the consent of the field’s manager or owner prior to issuing the notification.
The airspace of the exercise field shall be managed in accordance with the regulations set forth by the competent authorities of national defense and civil aviation.
Article 3
For the purpose of notification as outlined in Subparagraph 1, Paragraph 1, Article 3 of the Act, the military authority shall prepare a notification form for the military exercise field and shall send it to the notified authorities no later than fifteen days before the exercise begins. However, the following exceptions apply:
(1)If the exercise is required by an urgent military task, the notification may be sent at least 72 hours before the exercise begins.
(2)In the event of an exercise for the protection of airspace or territorial sea, the notification may be sent within a specified period after the exercise has commenced.
The Ministry of National Defense, in accordance with Paragraph 2, Article 27 of the All-out Defense Mobilization Readiness Act, shall jointly announce exercise zones with the Ministry of the Interior and notify the relevant authorities pursuant to these Regulations.
Article 4
The military exercise field notification form shall contain the following information:
(1) The legal basis for the notification.
(2) The military authority issuing the notification.
(3) The exercise field.
(4) The duration of the exercise.
(5) The notified authorities.
Article 5
The announcement of the military exercise field may be made by the military authority to the notified authorities through one or more of the following methods:
(1)Issuance of a flight notice or maritime notice.
(2)Use of broadcasting or wireless communication.
(3)Traffic control notices or the establishment of temporary traffic control facilities.
(4)Other appropriate methods.
Article 6
The military authority shall place notices in prominent locations on public lands or open public spaces near the exercise field, indicating the following information:
(1)The military exercise field.
(2)The duration of the exercise.
(3)Prohibited activities and penalties for violations.
(4)Any other necessary information.
Article 7
The military authority may establish security posts within the exercise field, where commanding officers or their authorized personnel shall direct duty officers, non-commissioned officers, or sentries to carry out security measures.
Article 8
Should the military authority halt, terminate early, or cancel all or part of the military exercise field or the duration of the exercise, it shall promptly notify the notified authorities.
Article 9
When the Ministry of Foreign Affairs receives a request from ad-hoc foreign ships, vessels, or aircraft for permission to pass through the airspace or territorial waters of the Republic of China, it shall notify the Ministry of National Defense with the intended passage times and routes.
Article 10
These Regulations come into enforcement on the same date when the Act is enforced.
