Article 1
These Regulations are formulated in accordance with Paragraph 4, Article 7 of the Military Installation Safety Protection Act (hereinafter referred to as “the Act”)
Article 2
The implementation of security inspections, forced eviction, and other necessary measures shall be conducted by appropriate means, shall not exceed the extent necessary, and shall be carried out with due regard to the physical integrity and reputation of the persons concerned.
Article 3
Sentries may conduct the following security inspections on persons or objects applying to enter the military installation :
(1)To require the permission or identification documents or documents for application to enter the military installation.
(2)To inspect personal belongings, vehicles, and the goods transported therein.
The security inspection under Subparagraph 2 of the preceding paragraph may be conducted using metal detectors or other technological devices.
If the goods in the vehicles or the personal belongings under Subparagraph 2, Paragraph 1 are deemed a threat to the security of the military installation, the sentries may order their surrender for inspection.
Article 4
A person who refuses or evades a security inspection, or fails to comply with military regulations upon inspection, shall be denied entry by the sentries and informed the reason.
If a person denied entry under the preceding paragraph engages in any of the following acts, the sentries shall take immediate action to stop such acts, forced eviction may be implemented :
(1)Obstructing the movement of personnel or materials into or out of the military installation.
(2)Interfering with the sentry’s performance of security duties.
(3)Posing any other threat to the security of the military installation.
Article 5
Sentries shall conduct security inspections in Artcle 3, Paragraph 1 on persons or objects leaving the military installations; for those who refuse such inspection, it may be enforced with force after informing them of the reason.
If any violations of military agency management regulations are discovered during such inspections, the sentries shall notify the duty officers and non-commissioned officers.
Article 6
The command of commanding officers at all levels or their authorized personnel (hereinafter referred to as "Commander"), duty officers and non-commissioned officers, shall promptly stop any individuals intruding into military installations without cause and may take the following necessary measures:
(1)Conduct the security inspections specified in Article 3, Paragraph1;
(2)Prepare a written record;
(3)Preserve evidence.
After taking the necessary measures under the preceding paragraph, if the Commander, duty officers and non-commissioned officers determine that there is no suspicion of a crime and no need for further security control of the military installation, the individual shall be ordered to leave immediately; if the individual refuses to comply, forced eviction may be carried out.
Article 7
When enforcing forced eviction by force, taking other necessary measures or encountering, individuals refusing to comply with security inspections, the commander shall be informed.
Article 8
Items discovered during security inspections that are subject to confiscation, seizure, or detention under the law shall be handled by the military agency itself or referred to the competent authorities in accordance with this Act or relevant regulations.
Article 9
If an individual objects on the spot to security inspections, forced eviction, or necessary measures taken under Articles 3 to 6, and the personnel deems the objection justified, the action shall be stopped or adjusted immediately; if not justified, it may proceed.
If requested by the individual, the personnel shall provide a written record stating the objection, the action taken (stop, adjust, or proceed), and the reasons.
Article 10
These Regulations come into enforcement on the same date when the Act is enforced.
